1. Introduction
These terms apply to services of Nomadisedexa GmbH, Lerchenfelder Straße 45, 1070 Wien (Nomadisedexa recording studio), for consumers under Austrian consumer law and for business clients (B2B).
Services include Vocals & voice-over, Band recording, Mixing, Mastering and Podcast & dialogue as described under Services. Your terms apply only if we confirm them in writing. The version at order confirmation applies (effective 15 October 2026).
2. Definitions
| Term | Meaning |
|---|---|
| Client | The person or organisation accepting a quote. |
| Consumer | A natural person acting for purposes outside trade, business or profession. |
| Business client | A person acting in the course of trade, business or profession. |
| Quote | Written description of service, date, price and payment sent by email or PDF. |
| Session | Agreed studio time including engineering. |
| Business day | Monday to Friday except public holidays in Vienna. |
3. Pre-contract information
Before booking, the site, FAQ and service pages describe scope, rooms (3 rooms, live room about 38 m², up to 5 musicians at once), workflow and guide prices. Quotes and order confirmations are binding. Contact: Contact, [email protected], +43 1 526 48 92.
Consumers concluding distance contracts receive mandatory FAGG information in text form.
4. Quotes and contract formation
We handle enquiries via contact form, email or phone within about 1 business day(s). Quotes stay open for 6 months unless a shorter date is stated. A slot is reserved only after written acceptance and deposit payment.
We may decline work for capacity, safety or legal reasons (e.g. uncleared samples). Browsing the website does not create a contract.
5. Prices and tax
Quotes are in euros. Consumer prices include 20 % VAT (examples: €98 per hour Vocals & voice-over, €295 per track Mixing, €450 album Mastering). Businesses may receive net invoices on request (€81.67 net per hour Vocals & voice-over).
Overtime beyond the booked slot is charged only with prior agreement, pro rata at the agreed hourly rate. Extras (stems, express delivery) require written confirmation.
6. Deposit and payment
A 30 % deposit of the total price fixes the appointment; it is credited against the balance. Payment by bank transfer; card in studio by arrangement.
Consumers pay the balance on the service day or on delivery of agreed exports for remote mix/master work. Business clients pay within 14 days of invoice. Statutory interest applies on late payment.
We may withhold final files until full payment; archiving rules below apply.
7. Rescheduling and cancellation by the client
| Notice before session | Effect |
|---|---|
| More than 7 days | Free reschedule or cancel; deposit refunded on cancel. |
| Between 7 days and 48 hours | Deposit applied once to a new date within 6 months; otherwise forfeited. |
| Less than 48 hours or no-show | Deposit forfeited unless force majeure applies. |
Notify changes in writing via [email protected]. Late arrival shortens session time if the next slot is booked. Consumer withdrawal rights in the next section remain unaffected.
8. Withdrawal for distance contracts
Consumers generally have 14 days to withdraw from distance contracts (booking by email/form without simultaneous studio visit) under Austrian FAGG. Send a clear statement to [email protected].
Withdrawal lapses if you expressly ask us to start before the deadline and confirm this. If work was already performed, you owe a proportional amount. For leisure services on a fixed date, withdrawal may be excluded when that date is bindingly agreed.
We provide a model withdrawal form on request. Refunds within 14 days of receiving your withdrawal.
9. Cancellation by the studio
If we cannot run a session (equipment, staff, official measures), we notify you promptly and offer alternatives. If you decline, we refund payments for unperformed work. Engineer changes only with your consent.
10. Sessions and studio rules
Hours: Monday to Friday 10:00–19:00, Saturday 10:00–16:00, closed Sunday. Sessions by appointment only.. Minimum age to book alone: 16; younger participants need written guardian consent and adult supervision. No smoking or vaping indoors.
Treat rooms and gear carefully and follow crew instructions. We may stop unsafe sessions; fees remain if the client caused the risk. Gear you bring stays your responsibility.
11. Files, formats and archive
Default delivery: WAV up to 96 kHz / 24-bit unless the quote says otherwise. Podcast exports in common formats. Handover via download link or your drive.
We keep session files 12 months after the last related service, then delete. Back up your data in time. Extended storage only by written agreement and fee.
See stems for mixing and master delivery formats.
12. Revision rounds
Mixing includes 2 revision rounds as described on the service page; Mastering as agreed in the quote. One round means feedback we implement in a single pass. Further rounds or a new artistic direction after approval are quoted separately.
13. Copyright and neighbouring rights
Your works: Music and lyrics stay yours. You warrant necessary rights (including samples and covers) and handle collecting-society filings.
Phonograms: Who initiates a recording generally holds neighbouring rights as producer. Because you commission and pay for recordings, those rights are yours; we assign any studio claims upon full payment.
Performers: Obtain written permission from musicians and speakers you involve.
AI: We do not use client recordings to train AI or create voice clones without written consent.
References: We name your project as a reference only with your approval.
14. Liability
We work to professional audio standards with due care. Artistic outcome also depends on your preparation; market success is not guaranteed (see disclaimer).
For slight negligence on essential duties, liability is limited to foreseeable, typical loss. Personal injury, intent, gross negligence and mandatory liability remain unaffected. For business clients, total liability per job is capped at the gross order value where permitted.
We are not liable for data loss if exports were offered and you did not back them up.
15. Force majeure
Neither party is liable for failure due to unforeseeable, unavoidable events. Inform the other party promptly. Payments for unperformed work are refunded or moved to replacement dates.
16. Privacy and processing
We process personal data under our privacy policy. Form data may route via FormSubmit (USA); alternatives are listed in the legal notice.
Business clients sending guest or artist data use our data processing agreement.
17. Governing law and jurisdiction
Austrian law applies, excluding the CISG. Mandatory consumer protections in your EU home country remain available.
Place of jurisdiction for businesses and non-mandatory consumer cases is Wien. Consumers may also sue at home. ODR platform: ec.europa.eu/consumers/odr.
We publish term updates on the website; existing jobs keep the version agreed at order. German is authoritative if translations differ.
